1. Assumption of Risk
By participating in any Treetop Session, you acknowledge that engaging in physical activity carries inherent risks, including but not limited to, the risk of injury, muscle strain, heart complications, and other health-related issues. You voluntarily assume all risks associated with your participation and agree that Treetop Fitness, LLC, its trainers and affiliates shall not be held liable for any injuries, damages, or losses incurred.
2. Individual Results May Vary
Health and fitness outcomes are highly individual and depend on multiple factors, including personal effort, genetics, and consistency. We do not guarantee specific results from participation in our training programs or services.
3. Release of Liability
To the fullest extent permitted by law, you hereby release, waive, discharge, and hold harmless Treetop Fitness,LLC, its owners and affiliates from any and all liability, claims, demands, or causes of action arising from your participation in our Treetop Sessions.
4. Virtual Training Considerations
For virtual training sessions, you are responsible for ensuring that your environment is safe and suitable for exercise. We are not responsible for any injuries or damages resulting from inadequate space, improper use of equipment, or lack of supervision during virtual sessions.
5. Cannabis Use and Legal Age Requirement
Some of our Treetop Sessions may include discussions on the use of cannabis for fitness, recovery, or wellness. Cannabis consumption is only permitted for individuals 21 years of age or older in accordance with Washington State law (RCW 69.50.401 et seq.). We do not provide, distribute, or sell cannabis products. Participants are solely responsible for ensuring they comply with all applicable local, state, and federal laws regarding cannabis use
By engaging in our services, you acknowledge that any cannabis use is done at your own discretion and risk. Treetop Fitness, LLC and its affiliates are not liable for any adverse effects, legal issues, or other consequences resulting from cannabis consumption before, during, or after participation in Treetop Sessions.
6. Forum Selection Clause
This Agreement shall be governed by and construed in accordance with the laws of the State of Washington, without regard to its conflict of laws principles. The parties agree that any dispute, claim, or controversy arising out of or relating to this Agreement, participation in any Treetop Sessions or use of the fitness studio’s facilities shall be brought exclusively in the state or federal courts located in Thurston County, Washington. Each party hereby consents to the personal jurisdiction and venue of such courts and waives any objection to the laying of venue herein, including any claim that such forum is inconvenient.
7. Changes to This Disclaimer
We reserve the right to modify or update this disclaimer at any time. It is your responsibility to review this page periodically for changes. Continued use of our website and services after any modifications constitutes your acceptance of the updated terms.
